Recent Updates in US Patent Law


This seminar will be held at Shortland Chambers on 8 June 2010, at 12.30 pm

Marcellus Chase is a registered U.S. patent attorney. He will present a brief (45-50 minutes) presentation regarding recent court decisions and their impact on U.S. patent practice. Some of the recent court decisions included in the presentation are:
  • Pequignot v. Solo Cup (and other False Marking cases)• KSR v. Teleflex (re-defining Obviousness)
  • Bilski v. Doll (Patentable Subject Matter - Machine or Transformation Test)
  • EBay v. MercExchange (Requirements to secure injunctive relief in a patent case)
  • Egyptian Goddess v. Swisa (Increasing the value of Design Patents)
  • Ariad Pharmaceuticals, MIT, and Harvard v. Eli Lilly (Separate Written Description & Enablement Requirements)

 New Text on Fiduciary Duties


Matthew Conaglen

Pictured (left to right): Bruce Gray QC, Dr Matthew Conaglen and Justice Heath at the New Zealand launch of Dr Conaglen's newly published text, Fiduciary Loyalty (Hart, 2010).  Justice Heath gave a speech launching the book at a function hosted by Shortland Chambers on March 24.  A graduate of the University of Auckland, Dr Conaglen is now a Fellow of Trinity Hall and Senior Lecturer in Law at the University of Cambridge. 

Dr Conaglen described his book as setting out a framework for understanding fiduciary duties, which he hopes will be useful for academics and practitioners alike.

 


New Junior - Matthew Windsor

 

 

The members of Shortland Chambers welcome Matthew Windsor as a junior.  Matthew came to us from the Court of Appeal of New Zealand, where he worked as a judge's clerk for the Hon Justice Grant Hammond.

Message from the Chairman of Chambers, Bruce Gray QC

 

The Chairman of Shortland Chambers, Bruce Gray QC, has said:

"There have been a number of highlights for Shortland Chambers this year.

Among them is a further award of the Shortland Chambers prize in Public Law.  This year's winner, Benedict Tompkins, is an outstanding undergraduate scholar.  Benedict has a wide field of interests, including public law.  We look forward to following Benedict in his further studies, and in his future career.

As well, our annual cocktail party held at the Northern Club was a crowded and happy occasion.  The Attorney-General, The Hon Chris Finlayson, was present and spoke.  He praised Shortland Chambers and made some well-chosen observationsabout the need for civil litigation to adapt to offer a more cost-effective and timely service.  Over 200 practitioners were present to hear these comments and to share in this annual event."

The members of Shortland Chambers welcome Anna Zhou as a junior.  Anna came to us from Mayne Wetherell, Auckland, where she worked as a solicitor in finance, corporate and commercial work.

New Members


Shortland Chambers is pleased to announce that it has been joined in Chambers by The Hon John Hansen DCNZM as an Associate Member, and Kevin Glover as a Member.

John Hansen has retired from the High Court Bench and is practising from Canterbury.  He is available to be instructed as an Arbitrator, or Mediator, and is willing to advise.  John can be contacted at Chambers, by Mobile 021 688 745 or email.

Kevin Glover joins Chambers from Bell Gully.  He specialises in intellectual property and is experienced in general commercial litigation.

Shortland Chambers welcomes these two new members and wishes them well in their careers at the Bar.

New Members


Shortland Chambers welcomes three new members, Andrew Barker, David Bigio and Naomi Cervin.

Andrew Barker has practiced as a barrister sole since 2002. He was previously a Lecturer at the Faculty of Law, University of Otago from 1999 to 2002, and a senior solicitor at an Auckland law firm from 1994 to 1998.

David Bigio has practiced as a barrister sole since 2003, and was previously a partner in an Auckland law firm from 1994 to 2003.

Naomi Cervin comes to chambers from Bell Gully, Solicitors, Auckland, where she practised as a solicitor since 2003, and more recently as a Senior Associate.

Annual Cocktail Function

The members of Shortland Chambers recently held their Annual Cocktail Function at the Northern Club on 7th May 2008.

The function was well attended by members of the judiciary and Auckland practitioners.

John Billington QC spoke to the 200 or so assembled guests before handing the floor to guest speaker, Dr Pita Sharples CBE, Co-Leader of the Maori Party.

Shortland Chambers Public Law Prize

On Wednesday 12th March 2008, John Billington QC, Chairman of Shortland Chambers (pictured below with Hamish McQueen and Professor Paul Rishworth), presented the Shortland Chambers prize in Public law to Hamish McQeen who obtained the highest marks in Public Law in 2007.

The presentation function at Shortland Chambers was attended by Justices Tony Randerson, Raynor Asher and Colin Nicholson, former members of Shortland Chambers, and a number of Auckland Law school lecturers and heads of department together with Hamish's parents and members of Chambers.

In presenting the award John Billington said that Shortland Chambers hoped to achieve two things in making the award, the first, to assist recipients like Hamish in advancing their careers in the law and second, to raise awareness in the profession of the importance of Public Law which as field of study and practice governs citizens relations with government through administrative, constitutional and criminal law.

New Junior - Sinead McLaughlin
The members of Shortland Chambers welcome Sinead McLaughlin as a junior.  Sinead came to us from Meredith Connell, Crown Solicitors, Auckland, where she worked as a law clerk primarily with the commercial team.  She also assisted with work in civil litigation and the Commerce Commission teams.

Annual Cocktail Function
Shortland Chambers recently hosted the first of what is to become the chambers Annual Cocktail Function for the Auckland legal fraternity.  This was held at the Northern Club on 17th May 2007, its purpose being to encourage collegiality and discussion amongst the Auckland profession.  John Billington QC spoke on behalf of members of chambers, and our guest speaker was The Hon Justice Rhys Harrison.  Key points of John Billington's speech including the practice of law in Auckland and the process of appointment of Queen's Counsel, may be viewed here.

Sam Carey
The members of Shortland Chambers farewell Sam Carey.  As a junior barrister these past two years, Sam ably assisted members in a wide variety of matters under the longstanding juniors scheme that chambers operates.  He also attended to editorial summaries in our Cases and Publications section of our website.  Sam will now be practising at Bankside Chambers, and we wish him well.

Push Play Corporate Challenge

Shortland Chambers entered a running team in the annual Push Play Corporate Challenge 5km Race at the Auckland Domain on 15th November 2006.  Our teams comprised of:

Men: Alan Galbraith QC, Grant Millar, Ian Williams, Harry Waalkens QC, Edward Taia, and Bob Hollyman.

Women: Jane Anderson, Catherine Garvey, Trudy Weinberg, Aimee Credin, Sandra Grant, and Bridget Slocum.

With a time of 17m57s, Jane Anderson took 1st place in the Individual Women's section.  The Shortland Chambers Women's Team came 2nd overall (1:34:54), and 1st in the Legal Challenge section.  The Shortland Chambers Men's Team came 3rd in the Legal Challenge (1:27:05).

20th Anniversary

Shortland Chambers recently celebrated the 20th anniversary of its formation, at the Northern Club on 7th September 2006.  Chambers was officially opened on 29th August 1986 by Sir Ronald Davidson.  At that time, there were 12 members of chambers and their staff occupying two floors at 70 Shortland Street.  Today, there are 26 members and staff occupying four levels.

Invitees to the celebration included His Worship the Mayor, members of the judiciary, colleagues within the legal fraternity, and past members and staff.

Julian Miles QC spoke at the gathering on behalf of the members, and The Rt Hon Justice Peter Blanchard replied.

It is anticipated the chambers will continue to practise for a further 20 years and beyond.
