General Background

Marc has appeared a lead or sole counsel in numerous judge alone hearings in civil and criminal matters (for example regulatory prosecutions for a variety of Government regulatory agencies including the Civil Aviation Authority, New Zealand Customs, the Ministry of Agriculture and Fisheries and others; for private clients and for the Crown in civil applications including debt recovery, interim, interlocutory and Mareva injuctions; for the Crown in habeas corpus and judicial review proceedings; for the Department of Corrections in Parole Board hearings; for the New Zealand Police on summary prosecutions, bail hearings, bail appeals and depositions hearings).

He has appeared as lead or sole counsel in numerous employment law disputes in the Employment Tribunal, the Employment Relations Authority, and the Employment Court.

His appearances include lead or sole counsel in numerous Health and Safety prosectuions for the Crown and for the defence.

He has appeared for the crown as lead or sole counsel in more than 100 criminal jury trials in the District and High Court.

Other appearances include:

  • Appearing for the New Zealand Police as lead counsel at depositions on three murder trials, and for the Crown as second counsel at trial.
  • Appearing as counsel in numerous High Court appeals from summary prosecutions, both criminal and regulatory.
  • Appearing as for the Crown (on secondment) in more than 30 criminal appeals before the Court of Appeal.
  • Acting as solicitor on numerous large scale commercial litigation cases, and as such advising on litigation strategy, drafting court proceedings and preparing evidence.
